These are Bills on the list of Licensing Documents in the Business Sector (Reg. No.1361), on amendments to the Law ‘On Licensing System in Business Sector´ (Reg. No. 1362), introduced by The President of Ukraine, and a Bill on Amendments to several Legislative Acts of Ukraine (appertaining to improvements to the procedure of issuing licensing documents), introduced by the People´s Deputy, K. Liapina.

 

Committee Chairman, N. Korolevska, focused the attention of the auditorium to the importance of these Bills, since they ‘aim to harmonise Ukrainian legislation, concerning the regulation of business with European standards, and optimise the procedures for the issue of licensing documents, etc.

 

The President of Ukraine proposes to adopt a comprehensive list of licensing documents relating to business, and purports that any other licensing documents required for business operations can only be added to this list through corresponding amendments to this Law, This list includes 140 documents ( current list included nearly 300 documents)

 

Thus, Committee Members stressed, ‘the number of licensing documents is reduced, and the possibility of their future uncontrolled and voluntary extension is restricted´.

 

Other amendments are directed towards simplifying the procedure of issuing licensing documents. A system for their issue, in a separate Licensing Centre is envisaged at a Regional level, and also in Kyiv and Sevastopol.

 

The Bill introduced by the People´s Deputy, K.Liapina includes a revised definition of the term ‘Licensing Document´, to embrace licences, conclusions, agreements, certificates, decisions, specifications, and any other documents issued prior to the licensing documents, or providing the ground for their issue.

 

A provision is added stating that, ‘a business entity acquires the right to operate his business without a licensing document, by forwarding a declaration to the State Administrator that his material and technical facilities meet the requirements of Legislation´. Any refusal to register would result in prohibition of the said declaration.

 

Since the introduced Bills are related to matters of further regulation of the Licensing system in Ukraine, Committee members resolved, in the outcome of their discussions, to introduce them on the Floor as a package for consideration at the Parliamentary Session. The Committee recommends that Parliament adopts the Bill on Amendments to the Law ‘On Licensing System in Business Operations´, Reg. No.1362, as a basis for further deliberations, and takes account of the provisions of the Bills, Reg. Nos 1361, 1245, in their preparation of this Bill for the Second Reading.
